Terms of service

These terms govern your use of TocoExam. TocoExam is operated by IT Nest Limited, a company registered in Hong Kong with its registered office at 99 Queen's Road Central, Office 3906, 39/F, The Center, Hong Kong ("we", "us"). By using TocoExam you agree to these terms. If you do not agree, do not use the service.

1. What TocoExam is

TocoExam is an independent study resource. It provides practice questions written from publicly available official study material for a range of written examinations, each with an explanation and a reference to the source it was written from.

TocoExam is not affiliated with, endorsed by, or connected to any government department, licensing authority, examination board or testing provider. We do not reproduce official examination content. Names of authorities and examinations are used only to identify which examination a question bank prepares you for.

2. No guarantee of a result

Practising on TocoExam does not guarantee that you will pass any examination. Our readiness score, pass verdicts and topic breakdowns are estimates derived from your performance on our questions, not predictions of an official result. Examination rules, question counts and pass marks are set by the relevant authority and can change without notice; you are responsible for confirming the current requirements with that authority before you sit an examination.

3. Accounts

You may use free practice without an account. Creating an account requires a working email address, which you must control. Access is by a one-time code sent to that address; you are responsible for keeping access to your mailbox secure. You must be at least 16 years old to create an account. One person, one account.

We may suspend or close an account that is used to abuse the service, to circumvent the free-tier limits systematically, to extract the question bank in bulk, or to break these terms or the law.

4. Free tier

The free tier includes practice mode on every published examination and a limited number of completed tests per day. Only completed tests count against the limit; a test you abandon costs nothing. The limit resets at midnight UTC. We may change the size of the free allowance, and we will publish the current figure on the pricing page. The limit does not apply to an examination you have paid access to.

5. Paid access to an examination

There is no site-wide plan. Paid access is bought for one examination at a time, and it opens everything paid inside that examination and nothing in any other. Depending on the examination, access is sold as a subscription, as a single payment, or both. Prices are shown on the examination's page and on the pricing page, may differ by the country you visit from, and include any tax we are required to collect where applicable. Payments are processed by Stripe.

A subscription is billed in advance for the period shown when you buy it and renews automatically at the end of each period unless you cancel. You may cancel at any time from your account, in one click, and you keep access until the end of the period you have already paid for. If a payment fails we may retry it and may suspend access until it succeeds.

A single payment buys access for the term shown when you buy it, or without an end date where the page says so. It never renews by itself. When a term ends, or a subscription ends, the paid parts of that examination lock again. Your progress, history and bookmarks are kept and open again if you buy access again.

We do not provide partial refunds for an unused part of a period or term, except where the law of your country requires one. To ask for a refund, write to contact@itnest.agency. If we change a price, the change applies to new purchases, and to a subscription from its next renewal; we will tell you by email before it does, and you may cancel before that renewal if you do not accept the new price.

6. Acceptable use

You may use TocoExam for your own study. You may not copy, scrape, republish, resell or redistribute the question bank, the explanations or any other content, in whole or in substantial part. You may not use automated tools to extract content, attempt to bypass the security check, share an account, or interfere with the operation of the service or with other users.

7. Intellectual property

The questions, explanations, artwork and software that make up TocoExam are owned by IT Nest Limited or licensed to it, and are protected by copyright. Names of examinations and authorities remain the property of their respective owners and are used for identification only. Your subscription grants you a personal, non-transferable licence to use the service; it transfers no ownership.

8. Content reports and corrections

We check every question against the official study material it was written from, and we correct errors when we find them. If you believe a question or explanation is wrong, use the report button in the player. We review reports but do not undertake to reply individually.

9. Availability

We aim to keep TocoExam available but we do not promise uninterrupted service. We may suspend the service for maintenance, and we may change, withdraw or add features. We will not remove a paid feature from an active subscription without offering a pro-rata refund for the remainder of the paid period.

10. Liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, nor for any loss arising from failing an examination, from examination fees, from lost opportunity, or from reliance on our content in place of the official material. Where liability cannot be excluded, our total liability to you is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

11. Termination

You may stop using TocoExam at any time and may delete your account from the settings page. We may terminate or suspend your access if you break these terms. On termination your right to use the service ends; sections 7, 10 and 12 survive.

12. Governing law

These terms and any dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of your country of residence.

13. Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed. Where a change materially affects your rights we will tell account holders by email at least 14 days before it takes effect. Continuing to use TocoExam after that date means you accept the updated terms.
